What it asks for
List all the ward’s property that you hold or know of, in a single written instrument. Attach the list of claims and your affidavit to it. §§1154.051–.053 (opens in a new tab)
| Item | What goes there |
|---|---|
| Real property | All the ward’s real property in Texas |
| Personal property | All of it, wherever it is: bank accounts, investments, vehicles, belongings |
| Separate or community | Which part is the ward’s separate property and which is community property |
| Owned with others | The ward’s interest in anything held in common |
| Value | Your appraisement of each item’s fair market value on the date letters were granted, or the appraiser’s if the court appointed one |
| List of claims | Every debt owed to the ward: the debtor’s name and address, the kind of debt, when it arose and falls due, the amount, and its interest rate and period |
| Affidavit | Sworn before an officer in the county: the inventory and list are true and complete |
Common mistakes
Counting from the order
The 30 days run from the day you qualify, not the day the judge signed the order. You may qualify up to 20 days after the order. §§1105.002–.003 (opens in a new tab)
Values on the wrong date
Value each item on the date letters were granted, not the day you file. §1154.051(b) (opens in a new tab)
Property found later
File a sworn supplemental inventory, appraisement and list of claims promptly. If the court orders one, file it within the time the order sets, 20 days at most. §§1154.101–.102 (opens in a new tab)
Your first account
Your first annual account is due 60 days after the first anniversary of qualifying. Property this inventory describes well enough can be named there by reference. §§1163.001(a), 1163.002(c) (opens in a new tab)
