Common mistakes

Income with no frequency

Each income item needs its amount and how often it comes. A Social Security check reads “$1,412.00 per month”.

Missing the 60 days

The clerk sends a notice. Thirty days later comes a citation to appear, then a show-cause summons. Thirty days after the summons, the court may remove you and appoint someone else. §34-1-110(b)–(c) (opens in a new tab)

No certificate of service

Davidson requires a copy mailed to every interested party, with its certificate of service attached.

Your first account

The first accounting is due 30 days after the six-month anniversary of appointment. See the annual accounting.

Unless the property is $25,000 or less and the court orders none, you also owe a property management plan (T.C.A. §34-1-115 (opens in a new tab)). Shelby and Davidson want it within 60 days of appointment, the same as the inventory.
