What it asks for

The law asks for a complete inventory of the estate. Mobile’s and Shelby’s forms, printed in each county’s conservator handbook, divide it into the same parts.

Mobile’s form also asks for every source of income with its amount, and any joint or payable-on-death accounts. It has you attach the bank papers that opened each estate account.

Each county sets its own filing fee. Jefferson County charges $14 for the first page and $3 for each page after it.

Taking over a conservatorship from another state? Your petition to accept it carries an inventory as of the petition date, with certified records of every bank account. Ala. Code §26-2B-302(a)(2) (opens in a new tab)

Common mistakes

Missing Mobile’s 45-day filing

Mobile County wants an interim inventory within 45 days, and the full one at 90. If nothing new turns up, tell the court in writing that no second inventory is needed.

Counting 90 days from the wrong date

The Law Institute’s model order sets the due date on the closest Friday after day 90. Your order may print a date of its own. Use that one.

Assets found after filing

Mobile’s handbook requires you to file an amended inventory promptly. The model letters say to report them to the court at once.

Your first account

Your first partial settlement accounts for the Part III accounts. Its recapitulation lists each account and CD again, with its balance on the closing date.
